This article deals with the institution of procedural participation, including some issues related to the concept of it in civil justice, the difference between these institutions from other institutions, and the problems of their application in practice. The problem of protecting violated or disputed rights and protecting legally protected interests is becoming particularly relevant in the context of the development of the legal system in the Russian Federation. The resolution of claims with the participation of one plaintiff and one defendant in the case does not always make it possible to protect the entire range of rights related to material legal relations. A new feature of the research is to study not only the theoretical side of the procedural process, discuss issues related to the concept, grounds and classification of the procedural process, but also to address and propose ways to resolve controversial issues related to the theory and practice of the application of procedural complicity.

In the present study the institution of complicity is considered, namely, the authors focus on the mastermind as one of the components of complicity. This type of complicity today has, from the point of view of the scientific community, quite a large number of debatable questions about its establishment as the “person behind the crime” and bringing it to criminal responsibility. Authors have tried to disclose the existing dispute and, accordingly, to offer a solution to the present controversial issues in the legal presentation of the national legislation. These judgments in scientific research could find a more effective incrimination of the positions proposed by the authors in practice.

The article reveals the legal nature of complicity in a crime, the objective and subjective signs of complicity, gives a description of complicity, examines the main problems that practitioners face in resolving the problems of criminal law regulation of joint participation in a crime, including the presence in the norms of the Special Part of the Criminal Code RF, provides a legal assessment of the legality of establishing responsibility for certain types of actions of accomplices, whose criminal liability is presented as independent offenses
