В статье осуществлена сравнительная характеристика понятий «законотворческий и законодательный процесс». Определено место в законотворчестве во всей структуре правотворческого процесса. Освещены позиции различных правоведов по поводу определения стадийности законотворчества, а также определена степень зависимости и соотношение процесса законотворческого и законодательного процесса в Российской Федерации. Определен круг субъектов законотворческого и законодательного процесса, степень их нормативного закрепления в законодательстве Российской Федерации, освещены коренные отличия субъектного состава. Названа основная сторона законотворческого процесса как процесса творческого, мыслительного, не находящего законодательного официального закрепления.

In the article various approaches to the definition of the concept of «lawmaking» are considered, the opinion of a number of large researchers of this issue is analyzed and the author's definition of the term is given. Despite the long-term discussion that continues in t broad scientific circles, a unified approach to the definition of the concept of «lawmaking» has not been worked out. This obvious legal gap creates confusion in the definition of the concepts of «law-making», «law-making», «legislative activity» and a number of others. This situation is unacceptable, which is evidence of the relevance of the issue under study.

In this article the author investigates the mechanism of the law-making process through the legal institution of law-making. The aim of the article is to identify the elements of law-making which are simultaneously the factors of influence on the law-making process. Basic components of the law-making are formulated, the definition in the unity of the law-making process understanding is introduced. Disclosed elements of the structure are proposed, providing complex of legislative procedures
